وضعیت حقوقی بستر دریاچه ارومیه پس از خشک شدن

چکیده

با توجه به پیش­‌بینی‌­های صورت گرفته خشک شدن دریاچه ارومیه آثار محیط زیستی و اقتصادی و اجتماعی زیانباری بر منطقه شمال باختری ایران خواهد گذاشت و این آثار می­‌تواند اساساً ماهیت حقوقی این دریاچه را به عنوان تالاب و پارک ملی تغییر دهد. به منظور پیش‌گیری از آسیب‌­پذیری بیشتر محیط‌زیست و جوامع محلی در برابر آثار این مخاطره بررسی وضعیت حقوقی این دریاچه پس از خشک شدن از لحاظ مسئولیت دولت در حفاظت از مردم در برابر این آثار آن و نیز حفاظت از بستر و سواحل خشکیده دریاچه لازم است. این مقاله با روش تحلیلی و آسیب‌­شناسی حقوقی به بررسی این مسأله می­‌پردازد که خشک شدن دریاچه ارومیه چگونه ماهیت آن را به لحاظ حقوقی تغییر می­‌دهد و اینکه چگونه باید از محیط زیست و جوامع محلی در برابر آسیب­‌های ناشی از این مخاطره محافظت کرد. این مقاله پس از شناسایی خلاءهای حقوقی موجود در زمینه مدیریت شرایط پس از خشکیدن این دریاچه به این نتیجه می­‌رسد که به منظور پیشگیری از وخیم­‌تر شدن شرایط محیط‌زیستی و انسانی در این منطقه، دولت باید راهبردهای عملی و فوری مشخصی را برای کنترل و کاهش آثار ناشی از این مخاطره، از جمله حفاظت از بستر و حریم ساحلی این دریاچه اتخاذ کند.

Lake Urmia drying up may pose hazardous environmental and socio-economic impacts on the northwestern of Iran and change basically the legal nature of this lake as a wetland and national park. Examining the new legal status of dried Lake Urmia in terms of government’s responsibility to protect the local people and environment against the impacts of this disaster is necessary to prevent more vulnerability against these impacts and to protect the lakebed and its coastal zones. Based on legal analytical pathological method, this article investigates how Lake Urmia drought changes its legal nature and how to protect the local people and environment against the impacts of this disaster. With regard to the legal lacuna in management of drought circumstances, the legal system should take the best available urgent strategies to control and mitigate the impacts of this disaster, to avoid worsening humanitarian and environmental conditions in this region and to enhance local adaptation and to protect the lakebed and its coastal zones.
